These Terms of Service ("Terms") govern your use of the website responsegenie.co.uk and the AI receptionist services provided by GB MEDIA LTD ("we", "us", or "our").   • "Service" refers to the AI voice assistant, call handling, and related dashboard features provided by ResponseGenie.

  • "Content" refers to call logs, transcripts, audio recordings, and other data generated through the use of the Service.

2. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for:

  • Ensuring that your use of the Service complies with all applicable local, national, and international laws, including telecommunications and data privacy regulations.
  • Obtaining any necessary consents from callers as required by law (e.g., notifying callers that calls may be recorded).
  • Maintaining the confidentiality of your account credentials.

3. Third-Party Infrastructure

Our Service relies on third-party providers for core functionality, including but not limited to voice synthesis, speech-to-text processing, and telephony infrastructure. By using the Service, you acknowledge that:

  • We act as an intermediary and interface for these technologies.
  • We do not control the underlying availability, accuracy, or performance of these third-party networks.
  • Data processed by the Service (such as call audio and transcripts) is fetched from these providers and stored in our database for your access.

4. Limitation of Liability

To the maximum extent permitted by applicable law, GB MEDIA LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, use, goodwill, or other intangible losses.
  • Damages resulting from your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us for the Service in the three (3) months preceding the event giving rise to the claim.

5. Indemnification

You agree to defend, indemnify, and hold harmless GB MEDIA LTD and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the Service, by you or any person using your account and password.
  • A breach of these Terms.
  • Content posted or transmitted using the Service.
  • Any violation of third-party rights or applicable laws (including caller consent laws).

6. Service Availability & Modification

We strive to keep the Service up and running; however, all online services suffer occasional disruptions and outages. GB MEDIA LTD is not liable for any disruption or loss you may suffer as a result. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

7. Subscriptions & Billing

Services are billed on a subscription or usage basis. You agree to pay all fees associated with your chosen plan. We reserve the right to change our pricing upon reasonable notice. Failure to pay may result in immediate suspension of services.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
